Department of Juvenile Justice Ordered to Refund Counties Who Overpaid for Detention Cost Sharing

Nabors, Giblin & Nickerson attorneys Gregory T. Stewart, Carly J. Schrader, and Heath R. Stokley, representing Marion, Polk, and Seminole Counties, were successful in obtaining an Order in Leon County Circuit Court requiring the Department of Juvenile Justice to refund collectively more than $9 million in overpayments made by the three counties for detention cost share.

The Firm had previously been successful in invalidating the Department of Juvenile Justice’s cost sharing rules before the Division of Administrative Hearings, which was affirmed on appeal before the First District Court of Appeal.  In addition, the firm also successfully appealed Final Orders of the Department of Juvenile Justice for three separate fiscal years, which paved the way for the Order granting refunds.
